Making a Will

Making a Will lets you decide what happens to your assets such as your property, money and possessions after your death.

If you die without a Will, the law says who gets what.

A Will lets you decide who would look after any minor children.

You can write your Will yourself, however, it is important to seek advice if your affairs are not straightforward. Scenarios such as sharing a property with someone who is not your husband, wife or civil partner, having property overseas, or where there are several family members who could make a claim on your Will such as children from another marriage. All need to be considered carefully.

At KMG we offer Will writing services whereby you can be sure all the correct legal terminology is included. We will complete an initial assessment with you on your requirements, provide a draft for you to approve and the final Will for signature.

Once your Will is drawn up, it is important that the document is signed, dated and witnessed in order for it to become legal.

Lasting Powers of Attorney

What would happen if you had an accident or an illness and could not make your own decisions (referred to as lacking mental capacity)? Who would you trust to help you make decisions on your behalf?

A Lasting Power of Attorney is a legal document that lets you appoint someone to assist you should the worst happen.

There are two types of Lasting Powers of Attorney:

  • Health and Welfare – for issues such as medical care, moving into a care home, life-sustaining treatment etc
  • Property and Financial Affairs – for issues such as managing your financial affairs and selling your home.
